AZ Ruling: Andy McCarthy – “Do it anyhow..”

  1. According to McCarthy, explain to the perps that you’re enforcing federal law. Such is Joe Arpaio’s plan.
  2. An important distinction: a policeman “may” still request citizenship information instead “must” request that information.
  3. The concept of “sanctuary city” was challenged. (Wake up Mayor Nutter!)
  4. Arizona also hands consequences to businesses that hire illegals. Our guests are impulsive, do not value education, and carry bad habits and disease. Joey Vento will pay more for his tomatoes; I hope that voters do with fewer illegals in restaurants, on mowers, and on roofs.
  5. T here were reports of illegals leaving Arizona. It could be that those who did not leave are more impulsive and less rule-compliant than those who did. The crime rate could remain high…

 Meanwhile, Jan Brewer makes an “expedited appeal” to the 9th Circuit Court and then to the U.S. Supreme Court. (Sidetrack: Limbaugh noted how depressed liberals and how upbeat conservatives tend to be. For example, a bunch of libs, depressed even at the NetRoots Conference, find reasons to complain. And conservatives generally react to Bolton’s ruling with optimism…)

Charles Krauthammer: “I think, for now, this is a very sweeping, but quite temporary victory for the opponents of the Arizona law. And the reason I think it’s a temporary one is I cannot see the Supreme Court ultimately upholding this ruling. There’s a fundamental contradiction in the middle of it, pointed out by, among others, former prosecutor Andy McCarthy, who makes this case. The judge’s argument is that the Arizona law is inconsistent with the federal law and therefore has to be enjoined against. The problem is, she is confusing the idea of the law and the federal enforcement of the law. So that her argument essentially is: Because the Arizona law–which, incidentally is drawn up to be entirely consistent with the federal law; it practically duplicates its language–because the Arizona law is contradicting the federal enforcement of the law, which is essentially not enforcement, therefore it is inconsistent with the law and has to be struck down. So, enforcing the federal law on behalf of the states is illegal because it goes against what the feds are doing, which is not enforcement. It is nuts. It does not hold up, and I think when it ends up in the Supreme Court, it’s going to be struck down.”

“Attorney General Eric Holder could have dictated most of Judge Susan Bolton’s decision blocking key parts of the Arizona immigration law.
“The judge twists facts and logic to support the Justice Department’s claim that the state law preempts the federal immigration scheme. To do so, she accepts Justice’s implicit argument that it’s not the letter of the federal law that matters, but what parts of the law the executive decides to enforce. If her reasoning stands, we will basically cut Congress out of immigration policy and the states out of enforcement. Instead, our immigration system will entirely depend on executive discretion at a time when the executive has little interest in enforcing the law.”

“Republican Commissioner of Bradford County Doug McLinko, who lives with Marcellus Shale reports on the positive impact in his county where he and his family and his friends live, and the negative impact of yet another tax, the Severance Tax:

 ‘The national economy is in a slump, unemployment remains stubbornly high, and economic growth is being hampered by misguided policies. Meanwhile, Bradford County, Pennsylvania led the Commonwealth of Pennsylvania in net job growth from March of 2009 through March of 2010 with 2500 new jobs or a 7.2% employment increase. The robust increase in jobs is a direct result of Marcellus Shale drilling and its ancillary economic benefits.

“…Main Street store fronts are occupied throughout Bradford County while hotels are being planned and constructed, restaurants are booming, and many mom and pop businesses are not only being saved they are seeing opportunity and prosperity as never witnessed before.

Marcellus drilling activity has allowed out of work men and women to earn a paycheck and feed their families. While others in the country are idled by unemployment, workers in Bradford County are learning and developing job skills. Trained workers ensure the area is attractive to prospective employers, which will lead to increased job creation and a diversified workforce.

‘The family farm is the soul of Bradford County. Over the years, farms have been sold due to low milk prices, high energy costs, and misguided agriculture policy. Government has implemented costly farm preservation programs with limited success. Marcellus Shale development has preserved more farmland than any government program at zero taxpayer expense. Bradford County farmers continue to feed America while meeting its energy demands.

The prosperity in Bradford County, however, is now threatened by spendthrift legislators and Governor Rendell. Due to years of budgetary mismanagement and fiscal recklessness, Pennsylvania’s bloated government is seeking more of your money. Rather than cutting expenses, Harrisburg is eying the growth in not just Bradford County but all of the Marcellus counties and determined to grab our wealth under the guise of a severance tax.

 ‘Proposals for a severance tax on our natural resources will inflict another onerous tax burden on property owners and private enterprise. This capital and job destroying tax will also mandate revenue generated from gas wells in Pennsylvania be directed to the state general fund.  These funds would be diverted to bus and train systems in Philadelphia and Pittsburgh, welfare programs, and failing school systems. Every dollar a severance tax stripped from Bradford County would be directed to Harrisburg’s general fund and there is no guarantee it would be allocated locally.

‘The gas industry isn’t asking for grants or tax breaks from a state government notorious for its tax and regulatory pitfalls. Rather, the amount of taxes generated from this industry is astounding. Billions of dollars in lease and royalty payments are subject to the state’s personal income tax. Marcellus Shale development is generating millions of dollars from sales, liquid fuels, hotel, and property taxes.

 ‘Absent the severance tax, companies developing the Marcellus Shale have invested tens of millions of dollars in local infrastructure, donated generously to local charities, and most importantly, have provided thousands of Bradford County families with substantial paychecks. Local governments are working assiduously with industry to mitigate infrastructure and environmental concerns. Any concerns raised about Marcellus Shale development are being resolved locally. A severance tax would only impede the economic growth while stymieing cooperation between industry and government. Frankly, local officials and community leaders will address Bradford County’s needs without Harrisburg grabbing its resources and wealth.’”

Chester County’s Constitutional Tea Party Conservatives would do well to find challengers to both Incestuous Incumbent Senators Andy Dinniman and Dominic Pileggi. Neither represents Limited Government nor Reform.

Today’s Republican leadership: Senators Bob Robbins , Dominic Pileggi, Pat Browne, Jane Orie, Joe Scarnati,  Jake Corman, Ed Erickson, & Michael Waugh.

Senator Robbins has an independent challenger, Roberta Biros, a committed and highly competent Real Deal Constitutional Conservative versus “been there too long” Sen. Bob Robbins.

Dominic Pileggi’s Web Site  Majority Floor Leader, publicly, says that Republican Candidate for Governor cannot keep his promise because, in my view, the NO NEW TAX pledge means that the government will not spend more than current revenues and that threatens the pork and WAMs that sustain are the source of incumbent protection. What makes this so disturbing is not only is the government currently spending more than its revenues but it faces BILLIONs in shortfall to pay State Pensions.

Facing a $ 5 billion dollar deficit, can Governor Tom Corbett keep his NO NEW TAX pledge? Republican Senate Majority Floor Leader Dominic Pileggi says “no”   Commonwealth Foundation thinks he can and gives specific $4 billion that can be cut.

“Senator Jane Orie faces trial and, likely, jail for misusing government tax money for private, partisan political campaigning to elect her sister, Justice Joan Orie, to the Pennsylvania Supreme Court. Janine Orie is the sister of Senator Jane Orie and Justice Joan Orie Melvin and was a $67,000 a year aide to Justice Joan Orie.”

“Binyamin Korn, founder and executive director of Jews for Sarah, has this op-ed in today’s Inquirer.

“As far as I know, Jews for Sarah, sometimes known as Jews for Common Sense, is the only Pennsylvania based Jewish organization exposing Joe Sestak’s ties to CAIR, Sharia and Islamism.

JewsforSarah will have an paid ad in this Friday’s Leftist Jewish Exponent explaining who Adeeba al-Zaman1 is and her relationship to US Senatorial Candidate Joe Sestak. To my knowledge, CAIR has never denounced HAMAS or HEZBOLLAH as Joe Sestak counseled in his address at the First Annual CAIR dinner in April 2007 and, yet, Joe Sestak refuses to condemn CAIR.

“As far as I know, in Pennsylvania, only Democrats have addressed CAIR Annual dinners.”

Group has ties to terrorists  The congressman should have been more wary given its history.
